Tiantai Law Firm Won the “Grand Slam” at the 2023 Business Exchange Conference of the Intellectual Property Committee of the All China Lawyers Association

With the theme of “High Quality Development and Innovation of Intellectual Property Legal Services,” the annual conference of the Intellectual Property Specialized Committee of the All China Lawyers Association was held in Shenzhen from October 21 to 22, 2023. The conference attracted more than 470 IP lawyers from all over the country to discuss the progress and hot issues on IP law practice. The senior partners from Taitai Law firm, Mr. Ma Xiang, Mr. Bu Xiaojun (Guangzhou Office) and the partner Tian Long (Beijing Office) attended the conference, on behalf of Tiantai Law Firm’s headquarter and its 29 offices across mainland China.

Mr. Ma Xiang delivered a speech at the main venue on the topic of “Lawyers’ Taking Advantage of Expertise to Provide Full-Chain and High-Quality Trademark Legal Services,” which summed up the 15 advantages for lawyers engaging in trademark legal services and encouraged lawyers to shoulder their historical mission in implementing IP Strategy and building a country with rich IPRs.

At the trademark law sub-forum of the conference, Mr. Ma focused on the significance of the protecting well-known trademarks, the path of protection and the existing problems. He also focused on how to use administrative litigation to protect well-known trademarks.

Mr. Bu Xiaojun, on topic of “Trial Supervision and Protest Procedure in Trademark Authorization and Confirmation Cases,” shared the case “Mona Lisa,” a well-known prosecutorial protest case of the Supreme People’s Procuratorate. He introduced in detail the process and operation practice of the protest procedure of the Procuratorate, especially the significance of “exhaustion of procedural rights.” In the sharing of “Observations and reflection on the Fifth Trademark Law Revision: Exploration of Provisions on Trademark Opposition and Invalidation,” Mr. Bu talked about the problems of adjusting the period of trademark oppositions, problems of the procedure for re-examination of non-registration of trademarks, and the related proposals for amending the procedure of trademarks invalidation.

In the speech of “The Role and Value of Lawyers’ Participation in Trademark Oral Review and Adjudication - Starting from the Case of ‘Original Brewing’ ”, Mr. Tian Long introduced how to apply for oral proceedings in major trademark review and adjudication cases and shared his ideas on how lawyers can better take advantage of their expertise to guide the parties to submit higher-quality evidence, how to make better use of trail confrontation in oral proceedings and how to accurately grasp the standards for the application of the law in the cases.

In the trademark salon activities organized by Mr. Ma Xiang, he introduced the historical development of trademark agency business in different periods, as well as lawyers’ great leap “from nothing to something” and their metamorphosis “from something to excellent.” Trademark lawyers from different provinces had warm interaction and in-depth exchange on how to carry out the trademark agency business better.

This annual conference organized the selection of “Excellent Litigation Cases” “Excellent Trademark Non-Litigation Cases” “Annual Excellent Books” and “Annual Excellent Papers” for the IP lawyers in China. The selection was made by the authoritative experts in the IP field, which is highly influential among lawyers. Tiantai Law Firm won all four awards, and was the only law firm with a “Grand Slam” in this conference, which fully reflected the leading position of Tiantai’s legal services on trademark litigation, non-litigation and theoretical research.
